Terms of business
Please read these terms carefully before using this website. They explain exactly what we do, what we do not do, and where responsibility sits. By submitting your details you confirm you have read and accepted them.
Our role, and what we are not
Bluebird Insurance is not an insurance company, insurer, underwriter, insurance broker, insurance agent or insurance intermediary. We do not underwrite risk, hold cover, issue certificates of motor insurance, register policies on the Motor Insurance Database, take on liability, handle claims or pay claims. Nothing on this website should be read as an offer of insurance by us.
What we actually provide is a document template and consulting service. We supply informational templates, indicative document formats and structured preparation help so that a person seeking short-term motor cover can assemble their vehicle, licence and personal details in the format insurers ask for. Where you ask us to, we then pass those details on to third-party insurers and providers so they can consider your request.
Every price, figure, estimate or comparison shown anywhere on this website is indicative and for general guidance only. It is not a quotation, not an offer, not capable of acceptance, and not a promise that cover is available to you or that it will be available at that price. Actual pricing, terms and acceptance are set solely by the insurer.
Submitting your details through this website creates no contract of insurance and places no obligation on any insurer. The insurer applies its own underwriting rules, acceptance criteria, pricing and checks, and may decline your request, request more information, or offer different terms, for any reason and without giving reasons to us.
Cover exists only once an insurer has accepted your request and issued its own policy documents, in its own name, directly to you. Until you personally hold those documents from the insurer, you are not insured and you must not drive. Do not rely on anything shown on this website, on any estimate, on any email from us, or on any template document as evidence that you are insured.
The insurer's own policy wording, terms, exclusions, excesses, cancellation rules and privacy notice govern any policy that results. We are not a party to that contract. We cannot bind, vary, confirm, backdate, extend, cancel or guarantee cover, cannot guarantee registration on the Motor Insurance Database, and cannot guarantee the timing or content of any document the insurer issues.
We do not give advice or recommendations. Nothing on this website is regulated financial advice, a personal recommendation, or legal or insurance advice. You are solely responsible for deciding what cover you need, for reading the insurer's documents, and for confirming your cover directly with the insurer before you drive. If you are unsure, take independent professional advice.
The accuracy of the information you give us is your responsibility. We pass on what you provide without verifying it. Incorrect, incomplete or misleading information may cause an insurer to decline your request, void a policy, reduce or refuse a claim, and may leave you driving uninsured, which is a criminal offence.
Insurers, providers and any third-party websites referred to here are independent of us. We do not control them, do not endorse them, and are not responsible for their acts, omissions, content or privacy practices.
Our service in practice
You enter vehicle and driver details on this website. We format those details into the template used by insurers, show you indicative figures so you know roughly what to expect, and, at your request, forward the request to one or more insurers or providers.
The insurer then contacts you or comes back to us with its decision. If it accepts, it issues the policy and documents directly to you and you deal with the insurer from that point on. If it declines, we may suggest that you approach another provider, but we cannot compel any insurer to offer you cover.
Your responsibilities
You must answer every question honestly, accurately and completely. Careless or deliberate misrepresentation can lead to a request being declined, a claim being reduced or rejected, and a policy being cancelled or treated as if it never existed.
You must hold a valid licence for the vehicle, have the registered keeper's permission to drive it, and comply with the conditions set out in any documents the insurer issues to you.
You must not drive until the insurer has confirmed cover to you directly.
Definitions
In these terms the following words have the following meanings.
- “We”, “us”, “our” and “Bluebird” mean Bluebird Insurance, a trading name of Klaptocz Consultants Limited, registered in England and Wales with company number 04047956, registered office 17 Broomfield, Elstead, Godalming, Surrey, GU8 6HH. Klaptocz Consultants Limited is part of Clareant Car Holdings Limited (company number 12667778, registered office C/O Quantuma Advisory Limited, 7th Floor, 20 St. Andrew Street, London, EC4A 3AG).
- “You” and “Customer” mean the individual using this website or asking us to prepare and forward their details.
- “Service” means the document template, formatting, preparation and consulting service we provide, including forwarding your details to Insurers at your request.
- “Template” means any informational document, form, checklist or indicative document format we make available to you.
- “Insurer” means any third-party insurance company, underwriter, broker, managing general agent or provider to whom your details are forwarded.
- “Fee” means any charge we make to you for the Service, which is never a premium.
- “Indicative estimate” means any price, figure, range or comparison shown on this website, which is guidance only and is not a quotation or offer.
Eligibility and capacity
You may only use this Service if you are at least 18 years old, are resident in the United Kingdom, and have the legal capacity to enter into a binding contract. If you are under 18 you must ask a parent or guardian to use the Service on your behalf.
You must use the Service as a consumer or on your own behalf, and you must not use it to submit details for another person without that person's informed consent to us processing and forwarding their data.
Meeting our eligibility conditions does not mean an Insurer will accept you. Insurers set their own age, licence, residency, vehicle and acceptance criteria, and those criteria are theirs, not ours.
Acceptance of these terms and formation of contract
By using this website, submitting details, or paying a Fee, you confirm that you have read, understood and accepted these terms. If you do not accept them, you must not use the Service.
A binding contract between you and us for the Service is formed only when we accept your instruction to prepare and forward your details, or when we take payment of a Fee, whichever happens first. That contract is for the Service alone. No contract of insurance is or can be formed with us at any point.
Fees, payment and refunds
Any Fee we charge is for the Service only. It is not a premium, it is not Insurance Premium Tax, and it does not buy, reserve or guarantee insurance. The Fee is payable whether or not an Insurer subsequently accepts your request, subject to your cancellation rights set out below.
Fees are shown in pounds sterling and are payable by card through our third-party payment processor at the time of instruction. We do not store your full card details. If a payment fails, is reversed, or is charged back, we may suspend the Service and recover any sums properly due to us.
Premiums, Insurance Premium Tax and any Insurer charges are paid to the Insurer under the Insurer's own terms. Any refund of a premium is a matter for the Insurer, not for us, and we have no power to authorise, accelerate or guarantee it.
Where a refund of our Fee is due, we will make it to the original payment method, normally within 14 days of accepting the request.
If you believe a payment is wrong, contact us at support@bluebirdinsurance.co.uk before raising a chargeback so that we can investigate. Raising a chargeback for a Service we have already performed at your express request may be recovered from you as a debt.
Your right to cancel (Consumer Contracts Regulations 2013)
Because you buy the Service at a distance, you normally have the right to cancel your contract with us within 14 days of it being formed, without giving a reason. This right relates only to our Service. Cancellation of any insurance policy is governed by the Insurer's own terms and its own statutory cooling-off period.
Most customers need their details prepared and forwarded immediately. If you ask us to begin the Service within the 14-day period, you expressly request immediate performance and acknowledge that you will lose your right to cancel once the Service has been fully performed, and that if you cancel part-way through you must pay for what has already been supplied. We ask you to confirm this before we begin.
If we have not yet begun preparing or forwarding your details, you will receive a full refund of the Fee.
To cancel, email support@bluebirdinsurance.co.uk stating your name, reference and that you wish to cancel. You may use the model cancellation form set out in the Regulations, but you do not have to.
You may stop using the Service at any time. We may suspend or end your use of the Service if you breach these terms, if we suspect fraud, or if we are required to do so by law.
Acceptable use and prohibited conduct
When using this website and the Service you must not:
- give false, misleading or incomplete information about yourself, any driver, any vehicle or any claims or convictions history;
- impersonate another person, or submit another person's details without their consent;
- use the Service for any unlawful purpose, including attempting to obtain cover for a vehicle you are not entitled to drive;
- scrape, copy, resell, republish or systematically extract any part of this website, its pricing logic or its Templates;
- abuse or manipulate any referral, promotional or partner scheme;
- introduce malicious code, attempt to gain unauthorised access, or interfere with the operation or security of the website.
Fraud prevention and financial crime checks
We and the Insurers we work with may check your details against publicly available information and against fraud prevention and anti-money-laundering databases in order to prevent and detect fraud and financial crime. By using the Service you agree to those checks.
If false or inaccurate information is given, or fraud is identified or suspected, details may be recorded with fraud prevention agencies and may be shared with insurers, other financial organisations and law enforcement. This may affect your ability to obtain insurance, credit or other financial services in future.
Where we suspect fraud we may refuse or stop the Service, decline to forward your details, and retain a record of the matter. Further information on how we use your data is in our privacy policy.
Intellectual property and your licence to use our Templates
All content on this website, including the Templates, text, layouts, graphics, logos and the Bluebird Insurance name, is owned by us or licensed to us and is protected by intellectual property law.
We grant you a personal, revocable, non-exclusive, non-transferable licence to use the Templates we supply to you for your own private, non-commercial purposes in connection with your own insurance request.
You must not copy, sell, sub-licence, distribute, publish or commercially exploit any Template or other content, or remove any notice of ownership from it.
No warranty as to Templates, information and estimates
The Templates, guides, calculators and indicative estimates are supplied for information only and on an “as is” and “as available” basis. We do not warrant that they are complete, current, error-free, suitable for your particular circumstances, or acceptable to any Insurer, and we do not warrant that this website will be uninterrupted or secure.
We do warrant, as we must under section 49 of the Consumer Rights Act 2015, that we will perform the Service with reasonable care and skill. Nothing in these terms affects that duty or your other statutory rights as a consumer.
Your indemnity to us
You agree to indemnify us against any loss, cost, claim, penalty or reasonable expense we suffer arising from information you give us that is false, inaccurate, incomplete or misleading; from your use of the Service in breach of these terms; from your use of a vehicle without valid insurance; or from any claim brought against us by a third party whose details you submitted without their consent.
This indemnity does not apply to the extent that the loss is caused by our own breach of these terms or our own negligence.
Limitation of our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your non-excludable statutory rights under the Consumer Rights Act 2015, or for anything else that cannot lawfully be limited or excluded.
Subject to that, we are not responsible for the acts, omissions or decisions of any Insurer. In particular we are not liable for an Insurer's decision to decline, delay, price, vary, cancel or void cover, for the content or timing of any document an Insurer issues, for registration on the Motor Insurance Database, or for the outcome of any claim.
Subject to the first paragraph of this section, we are not liable for any loss you suffer because you drove while uninsured, including any prosecution, fine, penalty points, vehicle seizure or disposal, or for any loss that was not reasonably foreseeable to both of us when the contract was formed, such as loss of profit, loss of opportunity or loss of business.
Subject to the first paragraph of this section, our total liability to you in contract, tort (including negligence), misrepresentation, restitution or otherwise, arising from or in connection with the Service, is capped at the greater of the total Fees you have paid us in the twelve months before the event giving rise to the claim, or £100.
We supply the Service for domestic and private use. If you use it for any commercial or business purpose we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.
Data protection
We process your personal data as a controller in accordance with the UK GDPR and the Data Protection Act 2018. The core purpose of the Service is to forward your personal data to Insurers so that they can consider your request, which we do to perform our contract with you and at your instruction.
Each Insurer is a separate controller of the data it receives and will process it under its own privacy notice. Full details of what we collect, why, who we share it with, how long we keep it and your rights are set out in our privacy policy, which forms part of these terms.
Electronic communications
You agree that we and, where relevant, Insurers may communicate with you electronically, and that documents, notices and information sent to the email address you provide satisfy any legal requirement that they be in writing.
It is your responsibility to give us a correct email address, to keep it in working order, and to check your spam folder. We are not responsible for messages that do not reach you because of an incorrect address or a filtering rule on your side.
Third-party websites and links
This website may link to Insurers, comparison services, review platforms and other third-party sites. Those links are provided for convenience only. We do not control, endorse or accept responsibility for their content, products, availability, security or privacy practices, and your dealings with them are entirely between you and them.
Events outside our control
We are not liable for any failure or delay in performing the Service that is caused by an event outside our reasonable control, including failure of Insurer or payment-processor systems, outages of DVLA, Motor Insurance Database or postcode data services, internet or telecoms failure, cyber attack, industrial action, fire, flood, epidemic, or act of government.
If such an event occurs we will let you know and will resume the Service as soon as reasonably possible. If the delay is substantial you may cancel and receive a refund of Fees paid for Service not yet performed.
Complaints and dispute resolution
Complaints about a policy, an estimate given by an Insurer, a claim, a cancellation or a premium refund must be raised with the Insurer that issued the policy. The Insurer will tell you about its own complaints procedure and about any right you may have to refer the matter to the Financial Ombudsman Service. Because we are not the Insurer and are not an FCA-authorised firm, we cannot investigate or resolve those complaints and the Financial Ombudsman Service does not cover our Service.
Complaints about our own Service can be sent to complaints@bluebirdinsurance.co.uk. We will acknowledge your complaint within 5 working days and give you a written final response within 8 weeks.
We do not currently subscribe to a certified alternative dispute resolution provider. If you are not satisfied with our final response you are free to take the matter to court, or to use any ADR provider that agrees to consider the dispute, though we are not obliged to participate.
Changes to these terms
We may change these terms from time to time, for example to reflect changes in the law, in our Service, or in the Insurers we work with. The version published on this page at the time you submit your details is the version that applies to that request, and changes are not applied retrospectively to a request already in progress.
We recommend that you re-read these terms each time you use the Service.
General
Assignment. We may transfer or subcontract our rights and obligations under these terms, provided this does not reduce your rights. You may not transfer your rights or obligations to anyone else without our written consent.
No third-party rights. Except as expressly stated, no one other than you and us has any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999. Insurers acquire no rights against us under these terms.
Severability. If any provision of these terms is found to be unlawful or unenforceable, that provision is severed and the remaining provisions continue in full force.
No waiver. If we delay in enforcing any part of these terms, that is not a waiver of our right to enforce it later.
Entire agreement. These terms, together with our privacy and cookie policies, are the entire agreement between you and us for the Service, and replace any earlier statement, marketing copy or representation, except that nothing here excludes liability for fraudulent misrepresentation.
Survival. The sections covering intellectual property, indemnity, limitation of liability, data protection, complaints and governing law survive the end of the contract.
Notices. Legal notices to us must be sent to legal@bluebirdinsurance.co.uk and are treated as received on the next working day. Notices to you are sent to the email address you gave us.
Governing law and jurisdiction
These terms, their subject matter and their formation are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
If you live in Scotland or Northern Ireland, you keep the benefit of any mandatory consumer protections of the law of the place where you live, and you may bring proceedings in the courts there.
